BITE Terms of Service

1. About these terms

These terms apply when you use BITE, the restaurant ordering product operated by JhaX.AI ("we", "us"), to find restaurants and order food through an AI assistant such as ChatGPT. By placing an order you agree to these terms and to the BITE Privacy Policy.

You do not need an account. You must be 18 or older and able to pay with a credit or debit card in your own name, or with the cardholder's permission.

2. Who you are buying from

Your payment is processed by the restaurant's card processor and paid into the restaurant's own merchant account. The restaurant's name may appear on your card statement.

3. The AI assistant

The assistant is a third-party service (for example ChatGPT, run by OpenAI) and follows its own terms. It may misunderstand a request. Before you pay, the payment page shows exactly what you are ordering and the total. Check it carefully — the order on the payment page is the order the restaurant receives.

Menu descriptions, dietary tags and photos come from the restaurant. If you have an allergy, contact the restaurant before ordering.

4. Placing an order

1. The assistant asks for your name, phone number and email address, plus a delivery address for delivery orders.
2. It gives you a link to a secure payment page showing your items, tax, any card fee and the total.
3. Your order is placed only when your card is approved. Until then nothing is sent to the restaurant and nothing is charged.
4. Once paid, the order goes straight to the restaurant's kitchen and you receive an email receipt.

The payment link expires after 30 minutes. If it expires, nothing has been charged; ask the assistant to place the order again for a new link. A link stops working after several declined cards, to protect against card fraud.

A restaurant may be closed when you order. The assistant will tell you if it knows, but an order paid while the restaurant is closed is handled under section 7.

5. Prices, tax and fees

• All prices are in US dollars and are set by the restaurant.
• Sales tax is added and shown before you pay.
• Prices are locked when the payment link is created, so they will not change while you are paying.
• Credit card fee: some restaurants add a fee of up to 3% to credit card payments. If one applies, it is shown on the payment page before you enter any card details, and the total updates when you choose credit. No fee is charged on debit cards.
• We do not charge you any service or booking fee for using BITE.

6. Pickup, delivery and ready times

Your receipt gives an estimated ready time. It is an estimate and may change with how busy the restaurant is. The restaurant may call or email you if there is a problem with your order. For delivery orders, the restaurant is responsible for delivery to the address you gave.

7. Cancellations

Because a paid order goes to the kitchen right away, you cannot cancel it through the assistant. To cancel or change an order, call the restaurant as soon as possible — its phone number is in your receipt and on the payment page.

Whether a paid order can be cancelled, and whether you get money back, is up to the restaurant and depends on whether it has started preparing your food.

The restaurant may cancel your order — for example if an item is no longer available or it cannot fulfil the order. If it does, you will receive a full refund.

If you do not pay, there is nothing to cancel: the order is never placed.

8. Refunds

• Refunds are decided and issued by the restaurant.
• Refunds go back to the card you paid with. Your bank may take several business days to show them.
• If your order is wrong, missing items or not delivered, contact the restaurant first. If you cannot resolve it with the restaurant, email support@jhapay.com with your order number and we will help put you in touch.
• If the payment page says your card was charged but the order could not be recorded, do not pay again. Call the restaurant with the reference shown on the page.
• You may also have rights through your card issuer, such as disputing a charge. Please try the restaurant first, as a dispute can take weeks to resolve.

9. Acceptable use

You agree not to:

• place orders you do not intend to pay for or collect, or give false details;
• use a card you are not authorised to use, or test cards on the payment page;
• use BITE to send large numbers of orders or payment links, or interfere with the service.

We limit how many orders and payment attempts can come from one phone number or device, and we may block use that looks fraudulent.

10. Our responsibility

BITE is provided "as is". We try to keep it working and accurate, but we do not promise it will always be available or error-free. The restaurant, not JhaX.AI, is responsible for the food and its preparation, delivery and quality.

To the extent the law allows, our total responsibility to you for any order is limited to the amount you paid for that order. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

11. Changes and governing law

We may update these terms. The version shown here when you place an order applies to that order. These terms are governed by the laws of the State of California, United States.
